Terms of Service — Engulfing Bull

1. Introduction

Welcome to Engulfing Bull, operated by Abhishek Bubna Academy, with registered office at Vyom, Block 5/1 Flat 3B, 49A Manmohan Banerjee Road, Kolkata 700038 ("we", "us", "our"). These Terms govern your access to and use of the Engulfing Bull platform, websites, mobile applications and related services (collectively, the "Service").

2. Definitions

"User" means any person who accesses the Service. "Content" means courses, lessons, videos, charts, AI-generated answers, and any other material made available through the Service. "Subscription" means a paid plan that grants access to specified Content for a defined period.

3. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an Account. By using the Service you represent that you meet this requirement and that the information you provide is accurate and current.

4. Account & Cognitive Primer Authentication

You are responsible for safeguarding your credentials, including any Passkeys registered with the Service. We use Passkey-based ("Cognitive Primer") authentication, OTP, and password fallbacks. You must notify us immediately at connect@engulfingbull.com of any unauthorized access.

5. Acceptable Use

You agree not to: (a) reverse engineer or scrape the Service; (b) share Account credentials; (c) re-distribute Content; (d) upload content that is unlawful, infringing, or harmful; (e) interfere with the integrity of the Service.

6. Subscriptions & Billing

Subscriptions renew automatically until cancelled. Pricing displayed is exclusive of GST unless otherwise stated. Indian customers will be charged GST at the prevailing rate via Razorpay; international customers via Stripe.

7. Refunds

Performer and Pro plans qualify for a 14-day refund from initial purchase. Foundation is free. Refunds for annual plans are pro-rated against actual usage.

8. Intellectual Property

All Content is owned by Abhishek Bubna Academy or its licensors. You receive a non-exclusive, non-transferable licence to access Content for personal, non-commercial educational use.

9. User-Generated Content

You retain ownership of content you submit (notes, mock-trade journals, reviews). You grant us a worldwide, royalty-free licence to host, display and use such content to operate and improve the Service.

10. Financial Disclaimer

THE SERVICE PROVIDES EDUCATIONAL CONTENT ONLY AND IS NOT FINANCIAL, INVESTMENT, OR TRADING ADVICE. Trading involves substantial risk of loss. Past performance is not indicative of future results. Decisions you make are your sole responsibility.

11. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from or relating to the Service is limited to the amounts you paid us in the 12 months preceding the claim.

12. Indemnity

You agree to indemnify and hold harmless Abhishek Bubna Academy against any claims arising from your breach of these Terms or your misuse of the Service.

13. Governing Law

These Terms are governed by the laws of India. Subject to the dispute resolution clause, courts at Kolkata have exclusive jurisdiction.

14. Dispute Resolution

Disputes shall first be attempted to be resolved by good-faith negotiation. Failing that, disputes will be settled by arbitration under the Arbitration and Conciliation Act, 1996, seated in Kolkata.
